Terms and Conditions
These terms and conditions apply to all paid services of LemonSuite (listing intelligence for Etsy sellers), in particular subscriptions and payments. Use of the website is governed by the Terms of Use.
These terms and conditions apply to contracts between the provider (Manuel Renda-Juckel, c/o M8Lab, Am Lichterkopf 39, 56112 Lahnstein) and you (customer) for the use of paid services of LemonSuite. Conflicting terms of the customer are not accepted unless we have expressly agreed to them in writing.
(1) The presentation of services on the website does not constitute a legally binding offer but an invitation to place an order. (2) By submitting the order (e.g. selecting a plan and clicking "Buy" or "Subscribe") you make a binding offer. (3) Confirmation of the order or provision of access constitutes acceptance. The contract is formed upon acceptance.
The specific services (e.g. scope of analyses, number of connected shops, support) are set out in the description of the chosen plan at the time of order. We provide the services according to the current state of technology and Etsy interfaces; no specific outcome (e.g. higher sales) is guaranteed.
(1) The prices stated at the time of order apply, including statutory VAT unless otherwise indicated. (2) Payment is made via the payment methods offered on the website (e.g. credit card, SEPA direct debit, PayPal or other displayed payment providers). (3) We may use third-party payment providers; their terms and privacy policies apply in addition for the payment process. (4) In case of late payment, default interest and reminder fees may be charged to the extent permitted by law.
(1) The term is determined by the chosen plan (e.g. monthly, annual). (2) Subscriptions renew automatically for the same term unless terminated before the end of the current term. (3) Termination may be informal (e.g. by email to support@lemonsuite.co) subject to the notice period under the plan. (4) The right to extraordinary termination for good cause remains unaffected.
If you are a consumer (natural person not acting in a commercial or self-employed capacity), you have a right of withdrawal under the statutory provisions. You will receive the specific withdrawal notice before you are bound by the contract (e.g. on the order page). For digital services, the right of withdrawal may lapse with your express consent before the withdrawal period expires, provided you have been informed of the consequence.
(1) We are liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. (2) For slight negligence we are liable only in case of breach of essential contractual obligations and only up to the foreseeable, typically occurring damage. (3) Liability under the Product Liability Act remains unaffected.
(1) The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. (2) For disputes with merchants the place of jurisdiction is our seat; we may also sue you at your place of residence.
